COUNSEL AT FIRST APPEARANCE

MAKE A DIFFERENCE

This project studies the effect of having defense counsel at first appearance (magistration). After being booked in jail, defendants face a magistrate judge who decides on the bond type and amount that defendants will have to pay to get out of jail. During that appearance, defendants do not have access to a defense counsel. This study examines whether having an attorney at magistration advocating on behalf of the defendant could have any impact on direct outcomes on bond type and amount, and long term outcomes such as recidivism, failure to appear, disposition, and sentencing. The research design is a randomized control trial in two counties in Texas (Hays and Potter Counties). The study also includes a cost effectiveness component.
